Teka Home app terms and conditions of use
ACCEPTANCE OF OUR TERMS
By creating an account or using our services, you are accepting the Terms and Conditions of Use of the TEKA HOME App (hereinafter the “T&C“). Therefore, by creating an account you confirm that you are know and have read these T&Cs, which shall be binding on you. If you do not wish to be bound by them, you should not register as a user or use the services provided.
By creating a user account, you confirm that:
- You are 18 years old, and you have the capacity to understand these T&Cs.
- You have purchased or have at your disposal a TEKA branded appliance listed in the body of this document.
You are expressly advised of the possibility that these T&Cs may change over time, so you may check the updated T&Cs at any time from the App, as well as from our website. If TEKA considers the changes to be material or important, a notification will be sent to the email address linked to your TEKA HOME account prior to the updated Terms taking effect. If you do not agree to the changes, you may discontinue using our services, as well as unsubscribe as a user. However, if after such communication, you continue to use our services, you confirm that you understand and accept the updated terms.
USE OF THE SERVICES
- LICENSE
By registering as a user of the TEKA HOME App, you are granted a limited, non-exclusive, non-transferable, revocable license to use our services. Any reference to our services includes all content related to our services, as well as any other material used to implement and provide you with access, including updates, upgrades, modifications, revisions or enhancements to our services.
You acknowledge and agree that TEKA INDUSTRIAL S.A. is the sole owner of the services, as well as the App, and that such services are protected by our copyrights, trademarks, trade secrets, patents and other intellectual or industrial property rights.
The availability and features of our services may vary depending on your location, the device you use or the version of the software or operating system you have, as well as the appliances or products on which they are intended to be used. We remind you that this App is not available for use with all TEKA appliances. Likewise, TEKA is not obliged to provide you with all services everywhere and for all types of devices and versions of software and operating systems.
- USER
In order to protect the security and confidentiality of all users, as well as to ensure that our services are available without interruption, you agree that:
- Reverse engineer is forbidden. Therefore, you may not reverse engineer, decompile or disassemble or make any attempt to discover the source code or algorithms of our services.
- You may not modify and/or disable any features of our Services.
- You will not create any derivative works based on our Services.
- You will not infringe our intellectual and/or industrial property rights.
- You are prohibited from using our Services in a manner that violates these T&Cs or any laws, rules, regulations, codes of practice, guidelines or other requirements of regulatory authorities, as amended from time to time, within the jurisdiction in which you are resident or from which you use the Services (“Applicable Law”).
- Use of our services in a fraudulent or malicious manner is prohibited.
- You will not use our Services for the purpose of damaging, disabling, overburdening, impairing or compromising our systems or security, or interfering with other users.
- USER TEKA HOME ACCOUNT
You will need a user account to use the TEKA HOME App. By creating such an account, you agree that:
- The information provided will be truthful, accurate and up to date.
- You will update your account if the information changes.
- You will protect your password and will not share it with anyone.
- You will contact TEKA immediately if you suspect that someone else is using your account without your consent.
We inform you that when you create a user account in the TEKA HOME App, the credentials provided will be the same that you will have created for all possible Apps and services that TEKA GROUP may provide, regardless of whether you are registered or not. In other words, if you wish to register for other services provided by TEKA GROUP, you will only have to use your username and password generated here. However, as indicated in the Privacy Policy, your data will not be shared with other applications without your consent or if you have not expressly registered.
- INTERNET
Use of the TEKA HOME App requires access to the Internet via WIFI. Therefore, you acknowledge that Internet access may result in costs depending on your tariff, and that TEKA is not responsible for the cost, availability or speed of your Internet network.
- UPDATES
TEKA HOME may make as many updates and upgrades as it deems necessary to provide the App with as much functionality as possible. These updates and upgrades are designed to improve, enhance and further develop the App, and may include bug fixes, revisions, improved features, add-ons and new versions. These updates will always require your consent and prior download without which the user will not be able to enjoy them.
However, certain updates that are marked as essential, (critical bug fixes or security updates) may be subject to automatic download and installation without your consent, all to protect you and other users.
- MODIFICATION
TEKA reserves its right to, at any time:
- change, add, suspend or remove functionalities of the App.
- Suspend or terminate your right to use our App, including access to your account or data.
- Review, filter, modify, reject, refuse, deny, block access to or remove all or part of the content of our App.
- Expand, delete or include product models
- PRODUCTS
The TEKA HOME App is compatible with the use of the following products:
- Ovens – HLB 8700 and HLB 8700P
- Hobs – IZF68600, IZF 68660, IZF 68800, IZF 68900, IZF 68960
- Hoods – DLV 99670 TOS BK
- NOTIFICATIONS
Any change, suspension or interruption of services will be notified to you as soon as possible and always taking into account the urgency of such action.
- LIABILITY
DISCLAIMER
The services provided by TEKA on the TEKA HOME app are provided “as is”, “where is” and “as available”, and without any kind of warranties. TEKA makes no representation or warranty of any kind, either express or implied, in connection with the services, and to the maximum extent permitted by applicable Law, especially, disclaims all warranties, including, without limitation, any warranties of merchantability, fitness for a particular purpose and non-infringement.
TEKA does not warrant that the services provided:
- are compatible with your hardware or software,
- will operate uninterrupted, secure and error-free,
- are always available and free of harmful components or errors, such as viruses, interference, corruptions and other security instructions,
- are secure and free from hacking or any other unauthorized use,
- meet your needs
TEKA is not responsible for the particular use that each user may make of the App with the connected product, as well as for the use of the product itself.
LIMITATION
TEKA shall not be liable, to the extent permitted by applicable law, for loss or damage in the following circumstances:
- where the loss is indirect, incidental, special, consequential or includes exemplary or punitive damages;
- for loss of profits, opportunities, data;
- where the loss is related to errors, omissions, connection or connectivity problems or network costs (this disclaimer of liability shall apply to the extent permitted by local country law).
- TERMINATION
BY THE USER:
The user may terminate these T&Cs by deleting his/her TEKA account, as well as by ceasing to make use of the TEKA HOME App.
BY TEKA:
TEKA reserves the right to suspend or delete your user account, or cease providing all or part of our services to you at any time, if any of the following circumstances apply:
- it has reasonable reasons to believe that the user has violated these T&C or the instructions provided for its use.
- Unilaterally decides to suspend its services (either worldwide or in the country where you reside or from where you are using the App).
- Is legally required under applicable regulations (for example, due to changes in applicable Legislation or court rulings or judgments that cause the Services or part of the Services to be deemed unlawful).
In the event of suspension or deletion of your user account, we will attempt to notify you via the email associated with your account or in a message that will appear the next time you attempt to access the account.
Termination of these T&Cs will not affect any rights, obligations and liabilities that you or we have accrued or incurred during the term of these T&Cs.
- APPLICABLE LAW AND JURISDICTION
These terms and conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which you are a resident, without regard to its conflict of law provisions.
- CONTRACT AND PARTIAL NULLITY
These T&Cs jointly with our Privacy Policy, as well as any additional documents, policies, regulations accompanying our services, shall constitute the entire agreement between you and TEKA and shall supersede any prior or contemporaneous oral or written communications, proposals and representations.
If any provision of these T&Cs shall be declared void, invalid, illegal or unenforceable (in whole or in part), the remaining provisions of these T&Cs shall remain in full force and effect. You may be subject to additional terms and conditions governing the use of third-party services, content or software.
- NO WAIVER
Failure to exercise or enforce any of the rights that TEKA may have recognized shall not be construed as a formal waiver of TEKA’s rights or remedies, which shall remain available for exercise.
- COMMUNICATION
By accepting these terms, you agree to receive a copy of all agreements, notices, modifications, disclosures and other communications by electronic means, including by email, pop-up or text message.
